The service is operated by SAIGOWORLD.COM | Global Online Martial Arts Community. By using the SAIGOWORLD.COM | Global Online Martial Arts Community Website you agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member ("Member"). Agreement to Terms of Use
This is a legal agreement between you ("you" or "user") and Saigo Elite, Inc. ("Saigo"). Please read these Terms of Use ("Terms of Use") carefully. Except as noted with respect to Third Party Content, these Terms of Use apply to the Saigo World and Saigo Elite web site located at www.saigoworld.com and www.saigoelite.com, and all associated pages linked to www.saigoworld.com and www.saigoelite.com by Saigo Elite,Inc., its subsidiaries and affiliates (collectively, the "Site"). BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE. Provided you agree and comply with these Terms of Use, Saigo grants you a personal, limited, revocable right to access and use the Site.

REGISTRATION

The Site is the property of Saigo and its affiliates and licensors. All content placed on the Site by Saigo, including, without limitation, all text, graphics, photographs, trademarks, logos, sounds, music, artwork and the computer code comprising the same (collectively, "Saigo Content"), and the design and arrangement of such Saigo Content, contained on the Site is owned, controlled or licensed by or to Saigo, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. The Site may contain "frames" or other similar structures or expressions which include content from third parties under contract, or given permission to advertise on the Site ("Third Party Content"). If such Third Party Content is subject to terms of use by a third party, such third party terms of use shall govern the use of such Third Party Content. User Content
Saigo does not claim ownership of the content you upload, submit or otherwise make available for inclusion on the Site ("User Content"). However, by uploading, submitting or otherwise making such User Content available on the Site, you grant Saigo a world-wide, royalty-free, non-exclusive, non-revocable, perpetual right and license to use, have used, distribute, have distributed, reproduce, have reproduced, modify, have modified, adapt, have adapted, publicly perform and publicly display such User Content (in whole or in part) for all purposes related to the operation of the Site or promoting the Site or Saigo. The above license shall be sub-licensable and include the right to create derivative works based on the User Content, which derivative works shall be owned by Saigo.

Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.

INDEMNITY
You agree to indemnify and hold Saigo, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees) made against Saigo by any third party due to or arising out of or in connection with (i) your use of the Site, (ii) your affiliation with Saigo, (iii) your inclusion of User Content on the Site and (iv) your violation of these Terms of Use.

VIOLATION OF THESE TERMS OF USE
You agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Saigo, for which monetary damages would be inadequate, and you consent to Saigo obtaining any injunctive or equitable relief that Saigo deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Saigo may have at law or in equity. You agree that Saigo will not be liable to you or to any third party for termination of your access to the Site for any reason.

GOVERNING LAW; DISPUTE RESOLUTION
You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of California without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Los Angeles County, California, and waive any objection to such jurisdiction or venue. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

VOID WHERE PROHIBITED
Although the Site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the Site are available to all persons or in all geographic locations, or appropriate or available for use outside the United States of America. Any offer for any feature, product or service made on the Site is void where prohibited. You are solely responsible for complying with applicable local laws.

MISCELLANEOUS
You may not use the Site or any Content in violation of any applicable laws or regulations, including without limitation United States export laws and regulations.

Saigo's failure to insist on or enforce strict performance of these Terms of Use shall not be construed as a waiver by Saigo of any provision or any right it has to enforce these Terms of Use, nor shall any course of conduct between Saigo and you or any other party be deemed to modify any provision of these Terms of Use. These Terms of Use shall not be interpreted or construed to confer any rights or remedies on any third parties.

UPDATES; TERMINATION OR SUSPENSION OF ACCESS
The information contained on the Site is subject to change at any time and without notice, and Saigo makes no commitment to update the materials on the Site, including information that may be out of date.
Saigo reserves the right to, at any time and without notice, modify, suspend or terminate operation of or access to the Site, or any portion thereof, or interrupt the operation of the Site, or any portion thereof. Saigo also reserves the right to terminate your account with Saigo at any time and without notice, and, in connection therewith, delete all your User Content.

It also provides the unique feature for specific members to Create, Launch and Manage their own Events within the SaigoWorld.com community. The services offered by SaigoWorld.com/Saigo Elite,Inc. ("SaigoWorld.com/Saigo Elite, Inc. or "we") include the SaigoWorld.com and SaigoElite.com websites, and any other features, content, or applications offered from time to time by SaigoWorld.com/Saigo Elite, Inc. in connection with the SaigoWorld/SaigoElite Websites (collectively, the "SaigoWorld and Saigo Elite, Inc. Services"). The Services are hosted in the U.S.
This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the SaigoWorld.com/Saigo Elite, Inc. Services. By using the SaigoWorld.com/Saigo Elite, Inc. SaigoWorld.com/Saigo Elite, Inc. reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the SaigoWorld.com/Saigo Elite, Inc. Services at any time, for any or no reason, with or without prior notice, and without liability.

You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. SaigoWorld.com/Saigo Elite, Inc. may terminate your Membership at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect, including sections 5-17.
3.Fees. You acknowledge that SaigoWorld.com/Saigo Elite, Inc. reserves the right to charge for the SaigoWorld.com/Saigo Elite, Inc. Services and to change its fees from time to time in its discretion. If SaigoWorld.com/Saigo Elite, Inc. terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.
4.Password. When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify SaigoWorld.com/Saigo Elite, Inc. immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
5.Non-commercial Use by Members. The SaigoWorld/Saigo Elite, Inc. Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by SaigoWorld.com/Saigo Elite, Inc. Illegal and/or unauthorized use of the SaigoWorld.com/Saigo Elite, Inc. Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the SaigoWorld.com/Saigo Elite, Inc. Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of Membership privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the SaigoWorld.com/Saigo Elite, Inc. Services.
6.Proprietary Rights in Content on SaigoWorld.com/Saigo Elite, Inc.
1.SaigoWorld.com/Saigo Elite, Inc. does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that you post to the SaigoWorld/Saigo Elite, Inc. Services. After posting your Content to the SaigoWorld/Saigo Elite, Inc. Services, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By displaying or publishing ("posting") any Content on or through the SaigoWorld.com/Saigo Elite, Inc. Services, you hereby grant to SaigoWorld.com/Saigo Elite, Inc. a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through the SaigoWorld.com/Saigo Elite, Inc. Services. Without this license, SaigoWorld.com/Saigo Elite, Inc. would be unable to provide the SaigoWorld.com/Saigo Elite, Inc. Services. For example, without the right to modify Member Content, SaigoWorld.com/Saigo Elite, Inc. would not be able to digitally compress music files that Members submit or otherwise format Content to satisfy technical requirements, and without the right to publicly perform Member Content, SaigoWorld.com/Saigo Elite, Inc. could not allow Users to listen to music posted by Members. The license you grant to SaigoWorld.com/Saigo Elite, Inc. is non-exclusive (meaning you are free to license your Content to anyone else in addition to SaigoWorld.com/Saigo Elite, Inc.), fully-paid and royalty-free (meaning that SaigoWorld.com/Saigo Elite, Inc. is not required to pay you for the use on the SaigoWorld/Saigo Elite, Inc. Services of the Content that you post), sublicensable (so that SaigoWorld.com/Saigo Elite, Inc. is able to use its affiliates and subcontractors such as Internet content delivery networks to provide the SaigoWorld/Saigo Elite, Inc. Services), and worldwide (because the Internet and the SaigoWorld/Saigo Elite, Inc. Services are global in reach). This license will terminate at the time you remove your Content from the SaigoWorld/Saigo Elite, Inc. Services. The license does not grant SaigoWorld.com/Saigo Elite, Inc. the right to sell your Content, nor does the license grant SaigoWorld.com/Saigo Elite, Inc. the right to distribute your Content outside of the SaigoWorld/Saigo Elite, Inc Services.
2.You represent and warrant that: (i) you own the Content posted by you on or through the SaigoWorld.com/Saigo Elite, Inc. Services or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Content on or through the SaigoWorld.com/Saigo Elite, Inc. . Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the SaigoWorld.com/Saigo Elite, Inc. Services.
3.SaigoWorld/Saigo Elite, Inc. Services contain Content of SaigoWorld.com/Saigo Elite, Inc. ("SaigoWorld.com/Saigo Elite Content"). SaigoWorld.com/Saigo Elite, Inc. Content is protected by copyright, trademark, patent, trade secret and other laws, and SaigoWorld.com/Saigo Elite, Inc. owns and retains all rights in the SaigoWorld.com/Saigo Elite, Inc. Content and the SaigoWorld.com/Saigo Elite, Inc. Services. SaigoWorld.com/Saigo Elite, Inc. hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the SaigoWorld.com Content (excluding any software code) solely for your personal use in connection with viewing the Saigo World Website and using the SaigoWorld.com/Saigo Elite, Inc. Services.
4.The SaigoWorld.com/Saigo Elite, Inc. Services contain Content of Users and other SaigoWorld.com/Saigo Elite, Inc. licensors. Except for Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the SaigoWorld.com/Saigo Elite, Inc. 7. Content Posted.
1.SaigoWorld.com/Saigo Elite, Inc. may delete any Content that in the sole judgment of SaigoWorld.com/Saigo Elite, Inc. violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. SaigoWorld.com/Saigo Elite, Inc. assumes no responsibility for monitoring the SaigoWorld.com/Saigo Elite, Inc. Services for inappropriate Content or conduct. If at any time SaigoWorld.com/Saigo Elite, Inc. chooses, in its sole discretion, to monitor the SaigoWorld.com/Saigo Elite, Inc. Services, SaigoWorld.com/Saigo Elite, Inc. nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
2.You are solely responsible for the Content that you post on or through any of the SaigoWorld.com/Saigo Elite, Inc. Services, and any material or information that you transmit to other Members and for your interactions with other Users. SaigoWorld.com/Saigo Elite, Inc. does not endorse and has no control over the Content. 2.harasses or advocates harassment of another person;
3.exploits people in a sexual or violent manner;
4.contains nudity, violence, or offensive subject matter or contains a link to an adult website;
5.solicits personal information from anyone under 18;
6.provides any telephone numbers, street addresses, last names, URLs or email addresses;
7.promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
8.promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
9.involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
10.contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
11.furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
12.solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
13.involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
14.includes a photograph of another person that you have posted without that person's consent; or
15.for all profiles, uses sexually suggestive imagery or any other unfair, misleading or deceptive Content intended to draw traffic to the profile.

In order to protect our Members from such advertising or solicitation, SaigoWorld.com/Saigo Elite, Inc. reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which SaigoWorld.com/Saigo Elite, Inc. deems appropriate in its sole discretion. If you breach this Agreement and send unsolicited bulk email, instant messages or other unsolicited communications of any kind through the SaigoWorld.com/Saigo Elite, Inc. Services, you acknowledge that you will have caused substantial harm to SaigoWorld.com/Saigo Elite, Inc. , but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, you agree to pay SaigoWorld.com/Saigo Elite, Inc. $50 for each such unsolicited email or other unsolicited communication you send through the SaigoWorld.com/Saigo Elite, Inc. Services;
18.covering or obscuring the banner advertisements on your personal profile page, or any SaigoWorld.com page via HTML/CSS or any other means;
19.any automated use of the system, such as using scripts to add friends, or favorites, or send comments or messages;
20.interfering with, disrupting, or creating an undue burden on the SaigoWorld.com/Saigo Elite, Inc. Services or the networks or services connected to the SaigoWorld.com/Saigo Elite, Inc. Services;
21.attempting to impersonate another Member or person;
22.using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
23.selling or otherwise transferring your profile;
24.using any information obtained from the SaigoWorld.com/Saigo Elite, Inc. Services in order to harass, abuse, or harm another person;
25.displaying an advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the SaigoWorld.com/Saigo Elite, Inc. Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, selecting a profile with a commercial purpose as one of your "Top 8" favorites, or sending private messages with a commercial purpose; or
26.using the SaigoWorld.com/Saigo Elite, Inc. Services in a manner inconsistent with any and all applicable laws and regulations.
9.Copyright Policy. You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of SaigoWorld.com/Saigo Elite, Inc. to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of proper notification to SaigoWorld.com/Saigo Elite, Inc. by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the SaigoWorld.com/Saigo Elite, Inc. No Software may be downloaded from the SaigoWorld.com/Saigo Elite, Inc. Services or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk.
15.Disputes. If there is any dispute about or involving the SaigoWorld.com/Saigo Elite, Inc. Services, you agree that the dispute shall be governed by the laws of the State of California, USA, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the State of California, City of Los Angeles.
